No Win No Fee*
No Win No Fee* arrangements are offered by Bridge McFarland Solicitors - supported where appropriate with insurance - at no cost to you*. We can provide insurance to ensure that if you lose your case, the policy protects you against any orders for costs subject to complying with the terms of any policy of insurance and / or conditional fee agreement. We can offer free initial legal advice and a free first interview to discuss your case and how the legal costs of your accident compensation claim can be met.
We have also carefully selected various legal service providers such as medical reporting agencies and barristers so as to ensure careful financial management of your claim throughout its duration.
Pre-event Legal Expenses Insurance
This is the most traditional form of legal expenses insurance. It is usually sold as an "add on" to a household or motor insurance policy motor breakdown cover and is also available through other financial institutions as well as associations or unions.
The insurance is provided over a period of 12 months and covers you for legal disputes you become involved in during this time. We will conduct the checks for you.
After-the-event Legal Expenses Insurance
After-the-event insurance is offered by Bridge McFarland where other alternative means of funding have been eliminated. It is purchased after a dispute has already started which may lead to legal action.
Conditional Fee "No Win No Fee" * Agreement
We may agree to act for you under a conditional fee agreement, more commonly known as "no win no fee". Under this type of arrangement your solicitor agrees not to charge you a fee if you lose your case. Because of this he is entitled to charge an extra fee called a "success fee", if you win your case. However, as mentioned earlier, if you win your case you should be able to recover your solicitor’s fees including the success fee from your opponent and so you will not have to pay them out of your own pocket.
Under a "no win-no fee" arrangement you will, however, still have to pay your opponent's solicitor's fees and both your own and your opponent's disbursements if you lose the legal action. To protect you from this, your solicitor can arrange the first form of after the event cover "conditional fee insurance" which will pay these costs on your behalf.
At Bridge McFarland we have carefully selected the most suitable insurance product on the market to provide this service to you.
The cost of after-the-event insurance can range from £350 to several thousand pounds, depending on what stage the claim settles, the type of dispute you are involved in, and the stage at which you buy the insurance.
After-the-event insurance premiums are recoverable from your opponent in successful cases, however in the event of there being a shortfall in the amount recovered this will fall to be paid by the individual.
Generally, conditional fee insurance for personal injury claims insured at a very early stage will attract the lowest premiums.
